"He was a h... more Gopal Subramanium said that he started going to the trial court as a student in 1978-79, with Mr. D P Wadhwa, who was a student of his father and later became a judge of the Supreme Court. "He was a hard taskmaster. Behind the very, very pleasant exterior, he was very demanding in terms of work hours and he used to work himself very very hard. I realised that the lawyer's first step was really in hard work." The Solicitor General and Chairman of the Bar Council of India was speaking to Rainmaker about early influences from the legal profession. After he joined the bar, he had the opportunity to join Soli Sorabjee as his junior. "Soli Sorabjee is not only a lawyer, a poet and a great human being. He also had a certain degree of paternal affection for his juniors. He was a very quick lawyer and one had to be very well prepared to brief him. We had to work overnight and keep a list of dates ready. He used to get up very early in the morning - around 4:30 or 5, and he would be reading the briefs very quickly before the juniors came. Then he would have a second round when his juniors came. In between, he would have a bit of apple and curd. That was his staple breakfast in the morning." Gopal Subramanium also said that Soli Sorabjee could deal with any branch of law. "Not many people know that he could have dealt with a criminal case with the equal ease with which he did a constitutional matter. He also has a very great gift of memory and all that he used to do was to mark the page numbers of his briefs and just a little - a word or two, to describe what had to be seen. So we all got into the habit, like Soli, of marking on the back of the brief. I'm afraid I tried mimicking him as far as note making is concerned, but I still have to make fairly longish notes." "I first met him before I became a lawyer and at that time it was a dream to be his junior. He had a moustache incidentally. He was arguing the St. Xaviers college case in 1974-75, before Chief Justice A N Ray. He spoke so eloquently, and with such passion and such clarity. You could hear his voice and enunciation very clearly." "I saw Mr. Nariman at about the same time. He had a thin pencil moustache. He was so meticulous and so well-prepared. He was known for not seeking an adjournment and was a very tough lawyer for the government. Nobody could easily get over his forensic opposition and his skill. When he resigned and got into private practice, he never ever flaunted his reasons or his possible disagreement with his government. There was a certain elegance when he moved over to private practice which I distinctly remember." Gopal Subramanium also remembered K K Venugopal's presence and pleasing personality. "He still has a very youthful appearance. He never used to offend a judge, and had a sense of logical presentation." When I joined the bar, Mr R K Garg - the indomitable R K Garg, used to crack a joke with me. "You're always very polite, very careful. I'm sorry, but past fifty, there will be nothing of this left." I thought he could not be right, but now I feel, that he was right. I can feel my inner strength and ruggedness and I feel it was a very perceptive remark. He also said that judges used to treat the juniormost lawyer with the same degree of respect as the seniormost lawyer. "When Chief Justice Chandrachud would close a case, he would thank each counsel by name and we would curtsy. It was a very beautiful tradition." less

Attorney General G E Vahanvati told Rainmaker that an overwhelming number of judges are honest and that it is a wrong impression that people have that there has been an erosion of values in the judici... more Attorney General G E Vahanvati told Rainmaker that an overwhelming number of judges are honest and that it is a wrong impression that people have that there has been an erosion of values in the judiciary. "Our Supreme Court judges are honest and hard working", he insisted. "High Court judges are also honest. Younger people are becoming judges. We have some outstanding judges in the Bombay High Court and the Delhi High Court. They come and tell me that all this talk about corruption and integrity affects them. Just imagine if you are an honest judge and everywhere you go, people are talking against the judiciary. How will you feel? You made a sacrifice to become a judge!". He said that the new Judicial Standards and Accountability Bill really is to protect these people and institutions. Describing the Bill, he said that it was "revolutionary" and that contrary to what people may say, it is meant to "protect the judiciary". There are three parts to it. Firstly, this Bill will give statutory recognition to the Restatement of Values, 1999 - which is the basis of the judiciary's work today. However, it has only been a voluntary code. Secondly, there is a formalisation of the declaration of assets. There must be a definition of assets. There must be a form. That has been provided for. The earlier objection about confidentiality is no longer relevant because the judges have voluntarily made disclosures on the website. Thirdly, this bill for the first time, gives an opportunity to an ordinary citizen to make a genuine complaint against a judge. "It will be properly investigated, but we are absolutely clear that no judge will be allowed to be harassed," he said. "We have a scrutiny panel, we have a National Judicial Oversight Committee which will then get the report from the scrutiny panel. If they are satisfied, then there will be an independent investigation. The complaint has to be verified, put on oath and supported by documents, without which you can be prosecuted with jail up to five years and fine up to five lakhs. So everything has been done to protect the judges while at the same time give a chance to people, because impeachment is a very difficult process. This will fulfill a long-standing need." The Attorney General also insisted that powers of Parliament are in no way affected. "We are not changing the concept that he can only be removed for misbehaviour or incapacity. We are defining misbehaviour," he said. "Our Prime Minister is one person who respects institutions and he will not let anything be done which is seen to interfere with the independence of the judiciary." On punishments for judges which stop short of impeachment, which is the only method prescribed by the Constitution for removal of a judge of a High Court or the Supreme Court, he said that the Bill envisaged minor penalties like censures, warnings or stopping the judge from working for some time. "Once you get a minor penalty, your progress will be halted" he said. less
